This website contains information regarding a class action lawsuit entitled In Re Air Cargo Shipping Services Antitrust Litigation, E.D.N.Y. Master File No. 06-MD-1775 (BMC) (VVP). This class action lawsuit is about whether air cargo carriers conspired to fix and raise surcharges on Airfreight Shipping Services. The lawsuit involves a class seeking money for direct purchasers of air cargo shipping services from Defendants.

The  purpose  of  this  website  is  to  provide  information  concerning  proposed settlements with Air China Ltd., Air China Cargo Company Ltd., Air India, Air New Zealand Ltd., and Atlas Air Worldwide Holdings, Inc., Polar Air Cargo LLC, and Polar Air Cargo Worldwide, Inc.

Air Cargo 5 Settlements

There are four additional Proposed Settlements totaling approximately $197.5 million with Air China Ltd., Air China Cargo Company Ltd., Air India, Air New Zealand Ltd., Atlas Air Worldwide Holdings,  Inc.,  Polar  Air  Cargo  LLC,  and  Polar  Air  Cargo  Worldwide,  Inc.   These settlements include class members who purchased Airfreight Shipping Services for shipments TO or FROM the United States directly from any of the Defendants from January 1, 2000 up to and including September 30, 2006.

Three  settlements  totaling  approximately  $190  million  with  Defendants  Asiana  Airlines,  Inc.,  EVA Airways Corporation and Nippon Cargo Airlines Co., Ltd have been approved by the Court. These settlements include  class  members  who  purchased  Airfreight  Shipping  Services  for  shipments TO, FROM or WITHIN the United States directly from any of the Defendants from January 1, 2000 up to and including September 11, 2006.


What Are My Options?

  • Submit a Claim: Unless you have already submitted an approved claim in connection with the Second, Third, or Fourth Settlements, this is the only way to get a payment. from these settlements, or from the previously approved settlements with Asiana Airlines, Inc., Eva Airways Corporation, and Nippon Cargo Airlines, Co., Ltd. If you have already submitted an approved claim, you can also update your claim to include purchases from September 12 to September 30, 2006, by submitting a supplemental claim form. You must submit a claim so that it is postmarked no later than September 9, 2016.

  • Go  To  A  Hearing: The  Court  will  hold  a  Fairness  Hearing  at  10:00  a.m.  on  October  5, 2016 in Courtroom 8D South at the United States Courthouse, 225 Cadman Plaza East, Brooklyn, NY 11201. You are not required to come to the hearing; however you may ask to speak to the Court about the fairness of the proposed Litigation Class settlements, the plan of allocation or the request for attorneys’ fees and expenses. If you wish to attend, your Notice of Intention to Appear must be filed with the Court and mailed to the attorneys by September 15, 2016.

  • Object: Write  to  the  Court  about  why  you  don’t  like  the  Proposed  Settlements, the Plan of Allocation, or the request for attorneys’ fees and expenses on either the Proposed Settlements or the settlements with Asiana, Eva, and Nippon Cargo. Your written objection must be filed with the Court and mailed to the attorneys by September 15, 2016.

  • Do Nothing: If you have not submitted an approved Claim Form for the Second, Third, or Fourth Settlements, you will get no payment and give up your rights. If you have already submitted an approved Claim Form for the Second, Third, or Fourth Settlements, you will automatically be included as a claimant eligible to receive a payment if the Proposed Settlements are approved, unless you excluded yourself from the Litigation Class before January 22, 2016.
